PRIVACY POLICY

I hereby acknowledge and agree:

 

To provide support effectively and safely in accordance with our agreement for services, Breastfeed Scotland will need to request sensitive personal information from you. In accordance with General Data Protection Regulations 2018 (GDPR) Breastfeed Scotland is required to inform you what data it will request from you, how the data will be process and what your rights are in relation to that data. The special categories of data that Breastfeed Scotland will hold about you will be in relation to you and your child’s health and your ethnic origin. Breastfeed Scotland will be both the Data Controller and the Data Processor, solely responsible for your privacy. Breastfeed Scotland will not request information from you that is not need in order to provide services to you for legal, contractual and legitimate reasons. Breastfeed Scotland will retain your consultation data for a period of 25 as required for insurance purposes.

The data Breastfeed Scotland will hold about you, may include:
Name, Date of Birth, Telephone numbers, Email, Address, Occupation, Partner’s name, Children’s name and date of birth, Medical history (including obstetric and breastfeeding history) of you and your children, Consultation notes including plans, Current Breastfeeding Concerns, Sensitive Personal Information such as your physical or mental health condition Breastfeed Scotland may receive, collect and store any information you enter on our website or provide us in any other way. In addition, Breastfeed Scotland may collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. Breastfeed Scotland may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. Breastfeed Scotland also may collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile.


All of your Data is processed by Breastfeed Scotland in the UK (for the reasons indicated below) using:
Gmail professional (Transport Layer Security – TLS) for follow up and marketing (with your consent)
Google Drive for storage of electronic records.


Our website is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.


With your consent, Breastfeed Scotland is required to share your consultation notes with your health care professionals. If Breastfeed Scotland is asked to provide any written reports or discuss your case with anyone (e.g. GP or Health Visitor) Breastfeed Scotland will discuss and agree this with you. The only exception to this rule is if Breastfeed Scotland is concerned you are at risk of harm to yourself or others, or are at risk of being harmed by another individual. In such a situation Breastfeed Scotland would have a duty to break confidentiality.
Where possible Breastfeed Scotland would still discuss this with your first. Anonymised data may be used and shared for the purpose of internal and external audits/research.


In order to ensure the best possible care, support and evidence based information is given Breastfeed Scotland have regular supervision. During supervision, your case may be discussed but Breastfeed Scotland will ensure anonymity by not naming you unless there is a risk of serious harm. In addition the Lactation Consultants and other practitioners who provide supervision also uphold current practice guidelines regarding confidentiality and will not disclose any information from the supervision session.

 

Sharing your personal information with third parties.
Breastfeed Scotland does not discuss your personal information with third parties. However, if Breastfeed Scotland's professional opinion found there was an immediate and serious risk that you might harm yourself or someone else then your personal information may be shared with a third party such as your GP or the emergency services without first obtaining your consent. This might be because it is not practically possible to obtain your consent or because attempting to do so might lead to a delay in accessing help and therefore endanger your life or that of another.


In situations where Breastfeed Scotland did have to share your personal information with third parties to protect you or another, Breastfeed Scotland will only share your personal information in so far as it is relevant and necessary to protect you or someone else. Breastfeed Scotland will inform you what personal information was shared and to whom. It is possible that your personal information may be requested by a Court of Law, Coroners Office or Professional Body in which circumstances you may have limited or no rights of refusal.

Note that Breastfeed Scotland may legally be required to share relevant information to the authorities for safeguarding purposes.

RIGHT TO COMPLAIN
You have the right to request a copy of the information that Breastfeed Scotland holds about you. If you would like a copy of some or all of your personal information, please email breastfeedscotland@gmail.com. The data Breastfeed Scotland wants to make sure that your personal information is accurate and up to date. You also have the right to correction of that data and deletion (where appropriate). You may ask us to correct or remove information you think is inaccurate. You have the right to ask to erase the personal information we hold about you. Breastfeed Scotland can refuse the request if your personal information is needed in the defense or exercise of legal claims, or we believe there is an overriding legitimate interest to retain your information.

Changes to this privacy policy.

You must read this privacy notice together with any other privacy notice I may provide on specific occasions when I am collecting or processing personal data about you so that you are fully aware of how and why I am using your data. This privacy notice supplements the other notices and is not intended to override them. Breastfeed Scotland will keep the privacy policy under regular review; this privacy policy was last updated on the 16th of March 2021.

If you are not happy with how Breastfeed Scotland manages your Data, you have a right to complain to the Information Commissioners Office (www.ICO.org.uk)
